1. Introduction
- The Buyer can access the Seller’s Website at www.kparkerjoinery.co.za.
- These Terms & Conditions govern the ordering, sale, and delivery of Made-To-Order products.
- By using the Website, the Buyer agrees to these Terms & Conditions.
- The Seller manufactures Made-To-Order products only after confirmed payment.
2. Important Notice
- These Terms & Conditions apply to consumers under the CPA, ECTA, and POPI Acts.
- Certain clauses may limit liability or create obligations for the Buyer.
- The Buyer is responsible for understanding these Terms before placing an order.
- Nothing in these Terms is intended to unlawfully restrict statutory rights.
3. Definitions
- Seller: K Parker Joinery CC.
- Buyer: The person or company purchasing products.
- Made-To-Order (MTO): Products manufactured after payment confirmation.
- Goods: Standard MTO products.
- Special Order Goods: Custom-sized or altered products including glass products.
- Third Party: Independent service providers such as couriers or installers.
4. Create an Account & Use of the Website
- The Buyer must create an account before ordering online.
- The Buyer is responsible for all activity under their account.
- The Website may not be used unlawfully or to interfere with operations.
- The Buyer must be 18 years or older or supervised by a legal guardian.
5. Conditions Applicable to Contracts
- Orders are only accepted once full payment is received.
- A Production Confirmation Notice confirms acceptance of the order.
- Orders may be cancelled subject to cancellation fees.
- Bulk purchases must be handled directly through sales representatives.
- The Product Guide forms part of these Terms & Conditions.
6. Made-To-Order Goods
- Products are manufactured according to standard industry practices.
- Colour, grain, and appearance variations may occur.
- Product descriptions are general guides only.
- The Buyer is responsible for ensuring correct sizes and specifications.
7. Made-To-Order Special Order Goods
- All glass products are classified as Special Order Goods.
- The Buyer is responsible for ensuring all specifications are accurate.
8. Errors
- The Seller will take reasonable efforts to ensure Website accuracy.
- The Seller is not bound by incorrect information displayed on the Website.
- The Buyer is responsible for confirming product suitability.
9. Price
- Prices exclude delivery unless otherwise stated.
- Prices include VAT.
- Prices may change due to exchange rates, labour, transport, or material costs.
- Additional costs arising from Buyer changes are payable by the Buyer.
10. Payment
- Secure online payment facilities are used.
- Payments may be made via debit card, credit card, EFT, or Instant EFT.
- Orders will not proceed until payment is confirmed.
- The Seller may request additional payment verification information.
11. Delivery of Products
- Products are considered in good condition at dispatch.
- All risk transfers to the Buyer after delivery or collection.
- The Buyer must report shortages or damage within 24 hours.
- Delivery schedules are estimates only and not guaranteed.
- The Buyer must provide access and unloading arrangements.
12. Non-Acceptance by Buyer
- Storage charges may apply if products are not collected or accepted.
- Products stored remain at the Buyer’s risk.
- Additional delivery charges may apply for re-delivery.
13. Return Policy
- Custom-made products generally cannot be returned.
- Returns are only accepted for delivery damage.
- Damage claims must be submitted in writing within 24 hours.
14. Defective Products
- The Seller aims to provide high-quality products.
- Natural timber variation is not considered a defect.
- Damage caused by misuse, incorrect treatment, or installation is excluded.
- Warping within acceptable tolerances is not considered defective.
15. Force Majeure
- The Seller is not liable for delays caused by events beyond its control.
- Force majeure events include strikes, floods, fire, shortages, and machinery breakdowns.
16. Warranty
- Wooden items carry a 5-year warranty.
- Ironmongery carries a 1-year warranty.
- Glass products carry a 10-year warranty.
- The Seller may repair or replace defective products at its discretion.
17. Glazing
- Glazing is only included if specified in writing.
- Where glazing is excluded, all responsibility passes to the Buyer or installer.
- The Seller is not responsible for glazing carried out by others.
18. Charges
- The Buyer may be charged for transport, storage, packaging, or failed collections.
- Products returned without proper packaging may incur surcharges.
19. Credit Buyers Account or Refunds
- No refunds apply to custom glass or Special Order Goods.
- Cancellation fees depend on the production phase reached.
- Refunds are processed within 10 business days where applicable.
20. Privacy Policy
- The Seller will take reasonable steps to protect personal information.
- Personal information may be used for processing orders and marketing.
- The Website uses cookies for functionality and analytics.
- The Seller will not sell personal information to third parties.
21. Changes to Terms & Conditions
- The Seller may amend these Terms & Conditions at any time.
- Continued use of the Website indicates acceptance of changes.
22. Electronic Communications
- The Buyer consents to receiving electronic communications from the Seller.
23. Ownership & Copyright
- All Website content is protected by copyright and trademark law.
- The Buyer may not reproduce Website content without written permission.

- The Seller makes no guarantees regarding uninterrupted Website functionality.

26. Limitation of Liability

27. Availability & Termination

- The Seller may terminate Website access for breaches of these Terms.
